Acceptance of Terms
By creating an account or sending a message through e-Gab SMS — via Bulk SMS, WhatsApp Business API, Email Marketing, OTP or USSD — you agree to these terms. If you use the platform on behalf of an organisation, you confirm you have authority to bind that organisation to these terms.
Accounts
You are responsible for keeping your account credentials and API keys confidential, and for all activity that occurs through your account. Notify us immediately if you suspect unauthorised access.
Acceptable Use
You may not use the platform to send unsolicited messages to recipients who have not consented to receive them, to send content that is unlawful, fraudulent, or abusive, or to attempt to circumvent rate limits, sender ID approvals, or WhatsApp template moderation rules. We reserve the right to suspend accounts that violate this policy while we investigate.
Sender IDs & Approvals
Custom SMS sender IDs and WhatsApp message templates are subject to an approval process before use, and may be rejected if they violate network operator or Meta platform policies. Approval timelines are outside our direct control where a third-party network or platform is the approving party.
Units & Billing
Bulk SMS, OTP and other metered services run on a prepaid unit balance. Units are deducted at the point of successful message dispatch. Marketing SMS and OTP/transactional SMS are tracked as separate balances and are not interchangeable. Package and subscription pricing for Email and WhatsApp services is confirmed at the time of purchase.
Service Availability
We work to keep the platform available and messages flowing without interruption, but delivery ultimately depends on third-party networks, gateways and platforms (including mobile network operators, Meta's WhatsApp Business platform, and Amazon SES) that are outside our control. We are not liable for delays or failures caused by those third parties.
Limitation of Liability
To the maximum extent permitted by law, e-Gab SMS is not liable for indirect, incidental or consequential damages arising from use of the platform, including losses resulting from message delivery delays or failures caused by third-party networks or platforms.
Termination
You may close your account at any time. We may suspend or terminate accounts that violate these terms, including the acceptable use provisions above. Outstanding unit balances at termination are handled in line with our Refund Policy.
